I. GENERAL INFORMATION

  1. This privacy policy (hereinafter referred to as the “Privacy Policy”): – sets out the principles of processing and protecting the personal data of users of the website https://mercor.com.pl (hereinafter referred to as the “Website”), to which the rights belong to “MERCOR” S.A. with its registered office in Gdańsk, address: 80-408 Gdańsk, GrzegorzaSanoka Street 2, registered in the Register of Entrepreneurs of the National Court Register maintained by the District Court for Gdańsk-Północ in Gdańsk, 7th Commercial Division of the National Court Register under KRS number 0000217729, share capital (paid up): PLN 3,914,633.75, Tax Identification Number (NIP) 584-030-22-14, National Business Registry Number (REGON) 008047521, BDO 000069623 (hereinafter also referred to as the “Company” or “MERCOR”);
    – regulates the terms of use of the Company’s trademarks and logos, as well as the content and materials posted on the website;
    – informs about the cookies used on the website.
  2. Using the website constitutes acceptance of the terms of the Privacy Policy.
  3. MERCOR is not responsible for websites accessible through links posted on the MERCOR website, nor for the administration of such external services.
  4. The website does not contain content that violates the rights of third parties, including intellectual property rights, applicable legal regulations, or information that could pose a threat to the privacy or security of any person.
  5. MERCOR reserves the right to change the Privacy Policy by publishing a new version on the website.
II. PERSONAL DATA:
  1. Whenever the Privacy Policy refers to “personal data,” it means any information about an identified or identifiable natural person, in particular: name and surname, identification number, and online identifier.
  2. The controller of personal data received via the website is MERCOR.
  3. MERCOR processes personal data in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter referred to as the “GDPR”) and other generally applicable provisions on personal data protection.

MERCOR processes personal data to enable website users to maintain business relationships with the Company, in particular to use materials and content posted in the login areas. Furthermore, personal data may also be collected and processed in connection with registration via the website for events, training courses, and competitions organized by MERCOR, subscriptions to newsletters (personal data processing for newsletter sending purposes), or for recruitment purposes.
  6. The information obtained by MERCOR will not be used for commercial or marketing purposes.
  7. Providing personal data is voluntary; however, failure to do so (in certain situations) will prevent the user from using certain features of the website (for example, in the case of the EDU project, it will not be possible to collect contact details and, consequently, provide feedback or materials). In particular, MERCOR will not be able to provide other materials or information, send a newsletter, or conclude and execute a contract. Providing data for contact purposes is also voluntary, but necessary to achieve this purpose.
  8. MERCOR processes personal data received via the website for the duration of the processing purpose, e.g., for the duration of negotiations, the execution of the contract, or services provided after its termination – until the expiry of the limitation period for claims within these scopes or the limitation period for tax liabilities – whichever is longer. The legal basis for personal data processing is Article 6(1)(a) and (f) of the GDPR.
  9. Data related to web traffic analysis collected via cookies and similar technologies may be stored until the cookie file expires. Some cookies never expire, so the data storage period will be equivalent to the time necessary for the controller (MERCOR) to achieve the data collection purposes, such as ensuring security and analyzing historical data related to website traffic.
  10. The recipients of personal data obtained via the website are MERCOR employees and associates. Furthermore, the Company may be required to disclose collected personal data upon request by courts, the Police, central or local government bodies, or other authorities.
  11. As a general rule, MERCOR will process personal data exclusively within the territory of the Republic of Poland. An exception to this may be statistical and analytical data. In this case, MERCOR transfers personal data to a so-called “third country” within the meaning of the GDPR, namely the United States of America.
    The United States of America is a country that is not part of the European Economic Area and does not meet the high standards of personal data protection applicable within the European Union. However, personal data is secure – we use a mechanism for transferring personal data between the European Union and the United States of America that complies with EU law. MERCOR entrusts the processing of personal data to processors (e.g., Google) based on data processing agreements containing Standard Contractual Clauses (SCCs). SCCs are model clauses adopted by the European Commission, referred to in Article 46(2)(c) of the GDPR, which are intended to facilitate the transfer of personal data while ensuring a level of data protection equivalent to that provided for by the GDPR.
  12. No automated decision-making, including profiling, will be used in the processing of personal data received via the website.
  13. In accordance with applicable data protection regulations, each website user whose personal data is being processed has the right to access their personal data, rectify it, erase it, restrict its processing, transfer it, object to its processing, or withdraw consent to its processing at any time, for example, by deleting it from the subscriber list or recruitment list. Please send any requests in this regard to the email address provided below. The user’s rights and requests indicated do not affect the lawfulness of processing based on consent given before its withdrawal.
  14. MERCOR reserves the right to refuse to delete user data if its retention is necessary to pursue claims or if required by applicable law.

  16. Each website user whose personal data is the subject of this Privacy Policy has the right to file a complaint with the President of the Personal Data Protection Office if they believe their personal data has been processed in violation of applicable law.
III.  INTELLECTUAL PROPERTY RIGHTS:
  1. The texts, graphics, logos, trademarks, images, videos, and other files posted on the website are the property of MERCOR and are protected by Intellectual Property Law. Their use is permitted in accordance with the following terms and conditions.
  2. Copying or using the content, images, videos, or other materials protected by Intellectual Property Law posted on the website – for commercial, professional, or other purposes – is permitted only with MERCOR’s consent or after entering into an appropriate agreement.
  3. MERCOR trademarks and logos may only be used after entering into an appropriate agreement with the Company.
  4. Any unauthorized use or distribution of trademarks, logos, or copyrighted content from the website may violate the law and be subject to legal action.
IV. COOKIES
  1. When browsing the website, cookies are used, which are small text files stored on the user’s device. Their use is intended to ensure the proper operation of the website.
  2. The cookies used by MERCOR are safe for user devices. In particular, it is impossible for viruses or other unwanted software or malware to reach the user’s device this way. These cookies allow us to identify the software used by the user and customize the website to their needs. Cookies typically contain the name of the domain from which they originate, the duration of their storage on the device, and an assigned value.
  3. MERCOR uses two types of cookies:
    a) session cookies: these are stored on the website user’s device and remain there until the browser session ends. The stored information is then permanently deleted from the user’s device. The session cookie mechanism does not allow the collection of any personal data or confidential information from the user’s device.
    b) persistent cookies: these are stored on the website user’s device and remain there until deleted. Ending a browser session or turning off the device does not delete them from the user’s device. The persistent cookie mechanism does not allow for the collection of any personal data or any confidential information from the user’s device.
  4.  MERCOR uses cookies to:
    – better customize the content and structure of the website, including adapting its content to the user’s individual preferences. These cookies recognize the user’s device and display the page accordingly;
    – compile statistics that help understand user preferences and behavior. Analysis of these statistics is anonymous and allows for the adaptation of the website’s content and appearance to current trends; the statistics are also used to assess the website’s popularity.
  5. “Cookies” may be used by advertising networks, in particular the Google network, to display advertisements tailored to the user’s use of websites. For this purpose, information about the user’s navigation path or the duration of their stay on a given page may be stored.
